Failed to secure deposit
My father entered a AST on a property he owned on 20 October 2018. He died on 24 October 2018. The deposit was not secured. I only discovered this on the tenancy end and immediately secured the deposit. We need to sell the property and I did not renew the AST. The tenant is refusing to move and had taken CAB advice and issued a letter before action for failing to secure the deposit. She is demanding 1-3 times the deposit to stop court proceedings. The agent who rented the property to her has advised me to return the deposit and this would be favourably looked on if I have to evict her. She never opens the windows and I have seen bad condensation on the inside and suspect that the room will be full of mould. I am reluctant to give back the deposit before inspecting.
