We own one flat in a building consisting of two residential flats and a shop on the ground and basement level. We have had ongoing discrepancies with the management company with regard to insurance contributions and maintenance in the communal parts.

We understand that we cannot exercise our Right to Manage given the commercial element on the ground and basement floors and therefore have been asked by the management company if we would be interested in taking a head-lease over the upper parts jointly and severally with the other Leaseholder?

I have researched online but the advice is very limited on this. Would head lease set up effectively be the same as if we were to set up a RTM company or are there restrictions and/or major differences?

Any advice on this and the process involved would be appreciated.
