We served a Section 21 towards the end of an AST and are due to serve form N5B. The tenancy is now periodic. Having looked at form N5B, the implication seems to be that it applies to an AST.
1)Does it matter that the tenancy is now periodic?
2)It is possible the tenant will want to postpone possession and plead exceptional hardship (2 months' arrears now owing). Should we be content that the request be considered without a hearing (Q.8)?
3)There is an outstanding repair which we have tried to address by giving notice of visiting the property - the tenant was not in, and by a contractor leaving a message for the tenant to contact him - so far, no response. Will this outstanding repair (appliance repair) cause a problem if we have to evict?
