Withholding all or part of holding deposit if prospective tenant changes mind.
I take two weeks holding deposit and sign a pre-tenancy agreement before I hold my flat for a prospective tenant.
I have just had two prospective tenants fail on me before they move in. The first failure wanted a clause in the contract to allow subletting and the second didn't come up with the funds in time of the move in date. I refunded them both their holding deposits but I can't really afford to do this again as it's costing me money.
In future, can I keep holding deposits if they don't come up with the funds in time? I'm thinking I was simply unlucky on this occasion.
