We're purchasing a property (due to complete on Wednesday) where all the tenants are on ASTs and from talking to the tenants have found that the landlord has taken deposits from them all but not protected them. The ASTs have no reference to a deposit.

Our intention is to get the landlord to pass all the deposits to us on completion and we will protect them same day.

As the new landlord will we be potentially liable for the late protection (all the tenancies are over 9 months old now) if a tenant makes an application to court?

If yes, is there anything that can be done so that the liability is old landlords and not ours? eg: if he returned the deposits before completion?
