I have agreed to let my tenant leave early (one month into a 6 month fixed term) even though there is no break clause in the agreement. I informed her that the property would be advertised and processed through a letting agent and she would be liable for the rent until the new tenant is found. This was agreeable and now the letting agent has found a replacement.

The problem I am facing now is the outgoing tenant is refusing to pay the letting agents fee. I realise that I forgot to mention the fees when I agreed to the surrender. Through no fault of mine and by trying to be accommodating I potentially stand to lose out financially.

My question is this. Can I withheld the letting agent fee from the deposit? If not how can I ensure that I do not lose out?
