Tenant has signed fixed term tenancy agreement for a flat in a building converted into flats.

Partner comes to stay a couple of weekends a month.

Initially landlord advised the student that she would have to pay an additional £20 per week if her partner came to say.

My understanding is that 2 nights is not occupancy. And I advised the tenant accordingly, she then spoke to the landlord who then said that it was an insurance matter and that no overnight guests were allowed.

Landlords assistant phoned me yesterday and said that clause o in the contract covered overnight guests.

‘o - Not to sublet or share occupancy without prior written consent of the landlord or otherwise part with possession of the property’

Does this clause actually prevent tenants from having overnight guests?

I would appreciate clarification.
