A new proposed tenant of non-European nationality has applied for a 6 or 12 month tenancy to start 1st May 2016. His Biometric Tier 2 (Restricted work) Residence permit expires mid July 2016. His foreign spouse has a Dependent Entry Clearance in her non-european passport stamped by Heathrow Immigration in March 2016.

The Right to Rent Checks have both been passed through our referencing agency and the GOV.UK website.

So, does this mean that any length of Tenancy can be granted as the Right to Rent checks have passed before the commencement of the tenancy or are we only authorised to grant a Tenancy up to the expiry of the Permit(s)?

What happens after the expiry? GOV.UK tell me that a renewed Biometric Permit can take up to 6 months to process.

...& I don't want a 3,000.00 fine!!!
