I have tenants who have refused to move out of my flat although our tenancy agreement has expired, I have been renting the place out through an estate agent and have been paying the agent renewal fees for the same tenants for the past six years. The tenants have stayed on in my flat without my permission or consent and I have applied for an accelerated possession order. They have paid some of the rent for the current month, which is the first one after the expiration of their tenancy agreement. The letting agent has had the gall to charge me commission on this rent payment. I have objected to this both over the phone and by email but they fobbed me off by saying that they needed to check this matter with someone more senior. I've read through all the terms of business that I signed, in addition to the tenancy agreement and I can't find anything that states that I am liable to pay commission in this type of situation. Can they really charge me?
