My tenant passed away in our property intestate in September as such a solicitor is acting as an administrator for the estate and pulling together the assets the tenant had, the tenancy still has not been surrendered to us as such can we submit a claim for the rent (from date of death) and damages to the property from the estate / assets before it is passed to the next of kin?

Our management agents are saying we will only recoup the deposit which is minute compared to whats outstanding.

Not a nice experience and its put myself and my wife under a lot of financial and emotional pressure but we just want it resolved.
