Our tenant has been on a periodic tenancy with us for some while. Rent is due 11th each month. She has just E-mailed us dated 20 Feb. terminating notice from 23 Feb. We used a Lawpack Buy to Let AST agreement which states, "...if the Tenant stays on after the fixed period (which was 6 months starting Feb 2007) his Tenancy will continue running from .....month to month. This periodic tenancy can be terminated by the Tenant giving at least one month's writen notice to the Landlord, the notice to expire at the end of the rental period." Surely the Tenant has the wrong dates for her termination. Her rent was paid in advance each month last paid on February 11th. Therefore, surely her notice can only commence 4 weeks from next payment due date i.e. March 11th which means she will vacate on or by April 11th. Help! Need prompt reply please as need to be reply back to her a.s.a.p. Please clarify correct dates and last payent due date. Many thanks.
