Hi,

One of my properties is occupied by a person who received the keys from the previous tenant. I did not know until the previous tenant gave me notice in writing that he was leaving. The occupant has not paid any rent and can not afford the rent I would charge. I would like to gain possession as soon as possible. The occupant has applied for council housing and the council has offered to re-house her until a council house is available, but she seem determined to stay.

1. What is the quickest way of gaining possession?
2. Having gained possession, can I sue her for rent covering the period the occupant stayed in the property.
3. Does the occupant have any lawful rights to stay.
