Some rented properties have solid fuel heating appliances. Here, landlords have a ‘duty of care’ to ensure that chimneys and flues are properly swept before a property is let out either initially or to new tenants. Section 11 of the Landlord and Tenant Act 1985 places responsibility on the landlord for keeping in repair and proper working order, the installations for provision of space heating. It is a good idea to use a sweep from the National Association of Chimney Sweeps who will give a certificate confirming the work done. The tenant also has a duty to ensure that these appliances are looked after, and should ensure that the chimneys and flues are swept regularly.
