I granted an AST for 6 months in April 2014. The original tenant has moved out but sublet to three people from whom he is getting much more rent than I am receiving from him. I have now realised that the council would consider a letting to three separate people to be an HMO and I want possession so I don't have to register it. Please advise what I should do. I have rad on another forum post that the AST would be invalid because the head tenant does not live in the property. If that's right do I just serve a NTQ on the subtenants and stop taking rent from the head tenant? If not what notices do I need to serve?
