Hello,

We have a tenancy expiring on 21st July 2016, which was for 12-months from 22nd July 2015. At the start of the tenancy, a Section 21 Notice was given at the same time, which was signed by the tenant.

A copy of the same notice (with tenant signature showing on it) was emailed to the tenant a couple of weeks ago.

Now the tenant has confirmed by email that she will not be vacating at the expiry of the tenancy, as she has not found another property.

As the tenancy started before October 2015, is the Section 21 Notice still valid?

As the tenant is clearly not going to vacate on the expiry date, there is a doubt that the rent may not be paid too. What is the procedure to vacate this tenant and when can the procedure be commenced?
