I signed a tenant for a six month AST on the 1/10/2014 which specified that after the inital six months period it reverted to a month by month agreement where either party must give "At least one calendar months notice to end the agreement with the notice to end on the anniversay of a tenancy period"
I issued notice in accordance with the Sec 21 notice issued on the 2/10/2016 (the day after the tenancy started) on the 11/08/2016 stating that the tenancy will end on the 1st October. This is more than the "at least one month" period specified in the agreement.
The tenant claims to have had legal advice and been told :-
- I must by law give two months notice minimum.
- I must issue another notice letter giving two months notice.
I also built a clause into the AST which states that the tenant must pay additional fees if they unreasonably withold viewings from the date either of us serve notice and this causes a delay in getting a new tenant. Is this legal ?
