I have a short hold tenancy agreement that commenced 13th October 2007 and that is the date the deposit was paid and protected with the DPS. Unfortunately I did not issue the prescribed information and the terms and conditions until 15th December 2012. If I now issue a section 21 or a section 8 will the judge make the tenant aware of the fact and will the tenant then be able to take me to court and claim damages?
