HMO Council Tax Listing
Hi, I have an 8bed HMO property in Cheltenham which was converted from a former grade 2 listed pub in December 2015. Having advised the Council of the change from commercial to residential use, we have recently been advised by the Valuation Office Agency that as each bedroom has an ensuite bathroom WC/shower/basin every room qualifies as a separate dwelling and hence each room is subject to an £979 council tax charge. The property has a communal lounge/dining/kitchen area; there is one central heating and hot water system, with one gas/water/elec utility meter; there were minor structural mods to accommodate the bathrooms and each bedroom door has its own lock. Each tenant has a 6month AST which provides access to the house with exclusive access to their own bedroom. We have registered an appeal with the independent Valuation Tribunal, which is due to hear the case in the next 6 months, but are you aware of any similar recent cases which I should be aware of, and/or any legislation which might assist in getting a revaluation as one dwelling with 8 tenants.
