Dear Advisor,
We do not take deposits anymore , however as per your new tenancy agreement, we take 2 months rent up front in advance. However, we are not sure whether the next payment falls due a month after taking up the tenancy (ie with always a month held in hand) or is the next rent collection due 2 months after tenancy start.(ie at end of two months there is nothing in hand) If this latter be the case then I do not understand para D8 of the AST Agreement,as there would be no circumstances where the landlord had any rent in hand provided notice had been given correctly ie on the aniversary of tenancy start date.Also am I not correct in saying that at no time can rent stand as a deposit for damages.
