I ask all my Tenants to provide a Guarantor who must sign a Guarantors Agreement binding them to the terms set out in the Tenancy Agreement between myself and the Tenant.
I have two questions which I would appreciate your help with:

Firstly; The Tenancy Agreement deems all Tenants jointly liable, the Guarantor Agreement guarantors the individual Tenant. Am I correct in thinking this would make the Guarantor in effect jointly liable for all tenants and is this 'fair' in the eyes of the law? - would is stand up in court and if not what could I do so that it would?

Secondly; Some of the guarantors return the Agreements, which are witnessed, but without a date on the witnessed signature.
Can a A) fill the date in myself
or do I B) have to send it back to the witness to be dated?
