Protected deposit 15 days after the 30 days period
Our prospective tenants at the time were moving from Spain, they had signed contracts and sent them back over by email but wouldn't get them witnessed in Spain
They had already picked apart the contract and returned the contract scanned singed but not witnessed. We received the deposit end of September 2015, they took the tenancy on the 24th October 2015 and we protected the deposit on the 5th November 2015.
We wanted to wait until the contract was properly signed by both parties and witnessed before protecting the deposit, but they didnít have a hard copy of contract singed and witnessed with their solicitors when they were back in the UK, like they said they would in an email
We gave it a week or two but still didnít receive the contract back so rushed to register the deposit 10 days after their tenancy began
In no way were we being negligent or trying to benefit from registering the deposit late
A month after the moved in they started picking apart the contract again, with points they had previously been agreed, so you can see why we were hesitant in registering the deposit and paying to do this
We still didn't have a hard copy of the contract signed and witnessed before we protected the deposit and don't to this date.
They have been unbelievable and twisted tenants causing issues and problems throughout the whole tenancy and we have recently found out they are known for this.
They are trying to claim 3 x the deposit back.
I would really appreciated some advice and thoughts on the best way forward.
