My son was named as the guarantor on an AST, which is now a periodic tenancy. He was named as such because the landlord told him and his friends that he couldn't take them all on otherwise the house became a HMO which is clearly isn't licenced to be. Having just read RLA's recommendations that the guarantor letter be renewed for every new tenancy I have two questions.
Does the landlord have any call on my son who has now left the property if anyone still at the house defaults?
Was there ever a contract in force due to the fraudulent nature of the agreement?
I have been telling my son from day one that the set up was dodging but it was the only way the group could all live together so they all agreed to it.
