Our non-paying tenants vacated the property yesterday of their own accord and left their keys, having removed their belongings except food). A cause for celebration. Now we want to try and recover the 3 months arrears (plus the 1 month additional rent theoretically due as they gave no notice, unless we re-let the property in this period.

They are an unmarried couple and we know they have returned to her mother's house where the girl lived before she moved into our property. So we have the mother's name and address from the original tenant information form.

Two questions please regarding when we apply for a CCJ or issue any legal notices:

  1. Can we address these to the former tenants, C/O the mother, as it is at her address? Or would this give her the legal right to open the mail and therefore breach confidentiality?
  2. For the CCJ, can we apply in the joint names of the former tenants so we pay only one court fee?
