Can you issue a live Section 21 with Form N5 when focus is on the Section 8 Possession Route
When completing the N5 Form for possession due to Section 8 Notice being served and expired, can you issue a live Section 21 with the N5 Form? Would this slow the possession order down? Can it be issued via the PCOL online system still? The RLA Guidance states the following but is this more if a Section 21 is main route?
"Please be aware that if you are issuing proceedings pursuant to a Section 21 notice and claiming rent at the same time you must tick “rent arrears” and “other”. In the box beside “other” you should state “the tenancy has been brought to an end by service of a notice pursuant to Section 21 of the Housing Act 1988.”"
