Evict a Tresspasser / Illegal Tenant
M Landlord) had verbally agreed with N to lease his property for a period of 7 years. The property is a corner plot and is described as a Commercial shop with a 2 storey flat above and joined to the 2nd property a semi-detached house with side garage (Garage with planning for conversion into a flat.
Nset up a new Limited Company – ECL at the address in Nov 2015 which entity would be known as the Tenant.
Terms were agreed verbally. The Semi-Detached house and the garage were not habitable. It was was completely stripped down and the garage did not have any utility accept from electric supply from the commercial property.
N managed to get a key from Mukesh for the property. In the meantime the lease terms were being agreed.
N then housed a tenant in the flat above in February 2016. A Tenancy was given to the tenant w.e.f. 01 March 2016. This is without consent of M.
Later on 01 July 2016 N housed a venerable tenant and her partner in the garage converted to a studio on an AST.
October. M asked N to return his keys as N had still not signed the lease nor provided the insurance documents.
A few days later M changed the locks on the office premises. Police was called and N collected his things from there and left.
N then applied to the High Court for an injunction to be given possession of the property. The court decided in favour of M on the 2nd of December 2016.
Kindly advise how to evict the subtenants who are now illegally in the property. No rent has been accepted from them by M.
