Our tenant is an assured tenant and our brother, but he has now passed away and the tenancy has been succeded by his wife. The original tenancy agreement stated that the rent was to be increased annually via the retail price index, and the monthly rent therefore has only increased from 65.00m per month from June 1991 to 97.00 per month in June 2006, although the current value for the property to rent on the open market is 650.00 per month. Can I submit a Section 13 rent increase order to her, giving the fact that the original tenancy agreement has this fixed rent increase on it?.
