Letting and Business rates

I recently purchased a property from a builder who subsequently rented the property from me for 6 months as they wanted to continue to use the house as a show property.
When I applied to the council for Council tax exemption they referred it to their Business rates section where it it is currently under investigation. Whilst this investigation is on going I am told I must pay the Council tax.

What is the law on this as I am sure that many of your members have similarly leased back to the builder. Is council tax payable and if so by whom, is Business rates payable and if so by whom. There was no tenancy contract between us only a letter confirming that the bulder would retain the property for 6 months.
