I am very new at this and have made all the mistakes I think it possible to make. I am working my way through putting things right but one area I am having trouble understanding fully is that I did not know I had to protect the tenants deposit until they asked me to do so (approx. 7 months into their tenancy) I then placed it into a protected scheme. My question is should I refund my tenant the deposit as I was the one who made the mistake (as some of the information I have read seems to say) or should I leave it alone and wait for the tenant to ask a county court to tell me to return it? I am trying to do the right and fair thing for my tenant. I look forward to any advice with this.
