Council Tax Payments

I have had a demand for council tax for one of our properties. On speaking to the tenant they informed me that they had contacted the Council and informed them that they are in a shared house and therefore the landlord is responsible for paying the council tax.

I have tried looking up information on HMO's but am noting getting the answers I need and the council aren't being all that helpful.

Basically it is a converted house that has been made into individual self contained apartments. This particular apartment has three tenants living in the property and have signed an Assured Shorthold Tenancy Agreement. From what I was aware this type of tenancy agreement insured that it isn't a HMO but the council are still saying the landlord may be responsible for it.

Do you have any info that would shed some light of this for me.
