Good afternoon Dave,

WE have a block of flats consisting of self-contained bedsits/studio flats. The tenants are not related to each other. They do not share any facilities except common entrance. They were converted 30 years ago without any formal planning permission.Not Licensed HMO.

The local council has alleged certain management breaches under: "Housing act 2004
The Licensing and Management of Houses in Multiple Occupation (Additional Provisions( (England) Regulations 2007
PACE Act 1984". (The alleged breaches are not the issue of this advice request).

Question: Is our property A HMO as defined by the above provisions and therefore the council is acting inter vires. Or should they be pursuing us under some other regulations.
