Will the RLA be updating the ASTs in light of Leeds Council vs Broadley?
The currently downloadable ASTs from the RLA say: "If, at the end of this time, you stay in the property the tenancy will continue as a statutory periodic tenancy."
However given that the recent Supreme Court case of Leeds Council vs Broadley held that the landlord was not liable for the council tax for 1 month after his tenant abandoned the property, only if it was a Contractual Period Tenancy and not a Statutory Period Tenancy, will you be updating your ASTs now to make them contractually periodic at the end of the fixed term?
