Situation - A tenant is living in a property with fixed term due to end 12th June 2017. The tenant has signed a new AST for a new fixed term starting 13th June 2017. Tenant has now changed their mind, and I have told them that as they have already signed they are contractually liable for rent until I can find new tenants to take over their lease.
However, they have come back and said that as there is no date of signature and the tenancy commencement date is in the future they are not liable as the agreement is not effective yet? Can anyone advise on contract law? if they leave on the last day of their existing AST are they liable for the rent as they have informed me of this before the contract start date?
