AST Rules on whether rent paid in advance or arrears
I wish to draft an AST where the tenant is to pay the Rent in Arrears and not in the more usual 'in advance'. This is because the tenant is going to be receiving LHA into her bank account to enable her to pay the rent since she is to be a full time student and is a single mother. LHA rules are that rent will be paid into her bank account for the previous fortnight, ie LHA will not pay rent in advance.
Q - Will it still be a legal AST document under the Housing Act 1988 and 1996 if rent is collected in arrears?
