I have a tenant (tenant A)who claims housing benefit and the benefit is paid direct to me. As far as i know, the tenant lives there by himself although his girlfriend stays over a couple of nights a week. I have 3 questions Firstly, would this be sufficient for the dss to deem that the tenant is no longer entitled to housing benefit ?. Secondly, can they demand that i pay back housing benefit that i have received in respect of this tenant that has been paid to me in the past? thirdly, is it true that if dss pay housing benefit to me in respect of another tenant (tenant B)at another of my properties, they can cancel these payments as a means of clawing back money that they deem they have 'overpaid' in respect of tenant A ? and further, that i cannot act against tenant B for non payment of rent.
