I am in the process of purchasing a buy to let. I am due to exchange today. The previous landlord has been managing the property.
Currently "he cannot remember" if he took a deposit from tenant, also the tenant has not paid his rent this month, he claims. Rent is normally paid around 3rd of the month.
I feel that I should not exchange prior to rent being investigated or deposit returned to tenant. My solicitor is not responsible for these issues as they are only doing the conveyancing. I feel that the tenant needs to sort out deposit with landlord then I can request new deposit from him.
