12 month AST finished in Dec 2006, I issues a new AST which included a rent rise which the tenant actually refused to sign. Therefore we lapsed into a periodic tenancy with him paying old rental rate.
I informed the tenant in writing of the increase giving one months notice before I expected it to be paid at incraesed rate, but did not use a specific form.
Question is, now tenant is moving out, can I deduct the unpaid portion of the rent from deposit or was notice not served properly or not enforceable?
