I sent out a Housing Act 1988 Section 13(2) notice to increase rent as of the 7th July 2017. It was sent a month prior to 7th July. On enquiring as to why I have not had a reply, the tenant claimed he had not received the notice and so I sent it as an attachment on 9th July. He still did not reply and when further quizzed, did not get a reply till 28th July informing me he was out of the country. He has asked me to post it again.
Since the dates on the notice have changed (are in the past now), I don't quite know what to do. Can I send him a revised notice with next due date on it, or can I use this one and apply the next rental date? I don't intend to claw back anything.
Am I even allowed to serve notice till next year now?
Your help would be most welcome.
