There often seems to be a problem if there is a wasps/bees nest, ants, rodents etc. at a property, as to who is responsible for their eradication. As a general rule, if the property had been infested at the time the tenants took over the tenancy, the landlord would be liable for eradication and the cost of any damage caused, eg. Rats and mice causing damage to tenants’ contents. However, if the infestation started some time after the tenants took over the tenancy, then the tenants are responsible. There is one exception to this rule, and that is if there was some problem with the property. For example, wasps built a nest in a dilapidated garden shed after tenants moved into property – landlord liable. This type of thing is not normally mentioned in a tenancy agreement.
