Failure to licence property and eviction
I am trying to evict tenants. Everything is up to scratch except that I do not hold a property licence. The council understands that I am trying to evict my tenants and have offered me exemption from licencing for 3 months.
I do not have any prior exemption from the licensing which came into effect in Jan 2017. So if I evict my tenants now could I be liable for having to repay my tenants for the period where I was trying to evict my tenants and yet did not have the required exemption from licensing the property?
Initial tenancy issued in nov 2016
initial S21 issued at same time (I know this is invalid)
New licencing rules came into effect in Jan 2017
New S21 issued in April 2017
Property is unlicensed at this point
Gas cert, epc and electric cert are all up to date
Dec 2017 Applied for exemption from licencing
Looking to apply to courts for possession on 27th Dec 2017.
What are your thoughts? Will I fail in evicting them?
