It seems our tenant is subletting - he says he's working away and has a friend staying to look after his dog. Our letting agent informed the tenant a while ago that the friend needs to fill in an application form to go on the tenancy agreement but he has not done so. This months rent has not been paid but the tenant was up-to-date with rent until this week. Today our agent has been round again and it now seems there are 2 males living there, neither of which are the tenant. We are about to serve notice but my questions are:
If the tenant has moved out and is not paying rent, can we assume he has given up the tenancy?
Do the people living there have any rights, and how do we get them out?
