Section 3 Notice - Landlord & Tenant Act 1985
We manage a property where the Landlord has passed away. The property has since been changed into the hands of the executors however the land registry still has the property under the deceseased name (he died about 1.5 years ago). The tenant is claiming that the tenancy is void as a S3 notice was not served when the Landlord passed away.
As the Land registry is still in the deceased name is there any breach?
If so, does this affect the deposit at all?
