Dear Landlords and experts, if at he start of a tenancy, a deposit, provided by the council for a Housing benefit tenant, has not been protected by the LL,

  1. can the tenant sue the LL for not protecting it, if he/she has not paid a penny themselves?
  2. Should the landlord,prior to serving S21, return the deposit to the Council or to the tenant? what proof would he need?
  3. Is it true that she/he can claim a return of the deposit + a penalty of up to 3 times the deposit dat the beginning of the fixed term and further 3 times when the fixed term ended and when the periodic term had started?

Has any landlord experienced that and been ordered to pay such an excessive amount? please share your vies and experience in this? thank you in advance
