Electrical safety certificate and downlights

I have had regular electrical safety certificates done and the property always passed fine. This time the electrician has failed it because the downlights on the ground floor are not fire rated. When they were fitted that was normal and I'm not clear that it has become against the rules now (rather than a recommendation) in standard houses and that the certificate should fail when it was fine at the time of install. Do they really or need changing?

Does anyone know the rules on this situation?
