Questions for LAT, (members welcome to join in):

  1. Landlords using the RLA tenant application form may inadvertently collect sensitive personal data. I assume that where this is volunteered by the applicant and not in answer to a specific question on the form then consent is implied? However, answers to questions about tenant names and relationship to each other may reveal information about sexual orientation for example. Does this mean that we always need to send consent forms with the application form, and are there any other requirements if this arises?
  2. Do I need to put together specific processing agreements with Openrent Rentguard whom I use for referencing, DPS - for deposit protection and Talktalk my ISP? What would be involved? Has anyone done this? Has anyone had any response from these agencies on this question as I have been unable to get them to engage on the issue?
