In a tenancy which is a protected tenancy under the Rent Act 1977, whether written or not, the tenant has security of tenure and the tenancy cannot be terminated except through the courts, and even then only in exceptional circumstances. It often happens that when investment property owners die and leave rented property where the tenant has been in-situ since before 15th January 1989, the beneficiaries may want to sell the property with vacant possession, and to do this try to evict the usually elderly tenant this is a criminal offence under the Protection from Eviction Act 1977. Further legal advice should be taken in each individual case.
