I lost a Section 21 Possession Order because the tenant argued that she had never been given the terms and Conditions of the DPS. A letting agent did the deposit for me, although we had proof of protection, didn't have proof of giving the DPS Terms and Conditions (although she had signed the Prescribed Information). My solicitor told me to refund the deposit after the hearing. I did this a month ago but it hasn't been reclaimed by the tenant. I am at my wits end, I feel I will never be able to win another Possession hearing. Can I just pay the tenant myself? If so, how should I do it? Thank you.
