Deposit fine affecting Section 8 hearing
I lost a Possession hearing using the Section 21 route due to not being able to prove the tenant had received the DPS Terms and Conditions. I now want to do a Section 8 Possession Order but my solicitor says that in addition to the two months rent owing, I must now also set aside three times the deposit as that will be the amount of my fine. This makes my Section 8 Possession unlikely to succeed. Can I just pay the fine of three times the deposit direct to the tenant before the hearing and so solve this problem? Thank you.
