Urgent advice please!
So, Iíll keep this brief and to the point!
We agreed with a tenant that she would pay in installments her £300 deposit. She stopped paying at £275: we have it written in the tenancy that it would only be protected once she had finished paying the £300, so we didnít protect it (hindsight obviously we should have), as things have not turned bad (were not in fault as landlords at all apart from not protecting the £275). Sheís not got wind that she can potentially take us to court.
She owes us loads of rent, was DSS and stopped paying top up. Hasnít let us in to do ANY repairs. Didnít answer her phone for a whole year. Weíve had a contractor tell us the house is empty, sheís moved out. She told us sheís moving out tomorrow, not paying any more rent (council payment), and sheís moved into the new house. The back gate is off as she wouldnít let us repair and my house in a bad area is now open to thieves.
So in short, do we quickly protect the £275? Do we have to if itís written on tenancy that itíll be protected once installments reach £300? Do we call her bluff and let her try court? Her arrears and repairs and redecorating etc would eat up any of that deposit anyway...
