Who is responsible for the TV licence?

We let fully furnished properties including a TV. The tenancy agreement clearly states that the tenant is responsible for the TV licence, however I note on the TV licensing website it states that even though the agreement states the tenant is responsible, if you provide the TV you can be fined too. Do you think this is legally sound or is it just TV licensing trying to make landlords responsible? Are you aware of any case law on this?
