Using section 8 if conditions of S21 not met
My tenant has not paid rent for 2 months and has stated that he will struggle in the future.
Unfortunlately I did not serve all the correct papers at the start of the tenancy, starting in August 2018. I now realise tenant could sue for 3 x deposit due to deposit not being protected in time, (it is protected now).
I am planning to use S8 once tenant is 5 months in arrears (ie they will stil lbe 2 months in arrears even if the 3 x deposit counterclaim is taken into account).
Has anyone else been in similar situation, and what action did they take to evict?
